The terms that govern your use of Ampersand and the ampersand.md website.

These terms govern your use of Ampersand and the ampersand.md website, operated by Serenity Software (“we”, “us”, “our”). By downloading or using Ampersand, you agree to these terms.

License to use Ampersand

Subject to these terms, Serenity Software grants you a limited, non-exclusive, non-transferable license to install and use Ampersand on Macs you own or control. You may use Ampersand for personal or commercial work. You may not sell, sublicense, redistribute, or attempt to defeat the application’s security or update mechanisms, except where applicable law expressly permits it.

Your documents remain yours

You retain all rights to the documents, notes, prompts, and other material you create or open with Ampersand. Ampersand processes that material privately on your Mac; you do not grant Serenity Software ownership of it.

AI-generated suggestions

Ampersand’s on-device AI may produce incomplete, inaccurate, or unsuitable suggestions. You are responsible for reviewing generated material and deciding whether it is appropriate for your work. Do not rely on AI-generated content as professional, legal, medical, financial, or other expert advice.

Acceptable use

You agree not to use Ampersand or the website to violate applicable laws, distribute malware, interfere with the service or its update infrastructure, or infringe the rights of others.

Third-party software

Ampersand includes open-source software and may download an AI model selected for your Mac. Third-party components remain subject to their respective licenses and notices.

Updates and availability

We may release updates that change, improve, or remove features. We do not guarantee that Ampersand, its website, downloads, or update services will always be available or error-free.

Data and privacy

Our Privacy Policy explains how Ampersand handles information and is incorporated into these terms.

Backups and data loss

You are responsible for maintaining backups of your files. Although Ampersand works with files in folders you choose, software errors, hardware failures, and other events can cause data loss.

Disclaimer and limitation of liability

Ampersand and the website are provided “as is” without warranties of any kind. To the fullest extent permitted by law, Serenity Software disclaims liability for indirect, incidental, special, consequential, or punitive damages, including loss of data, work, revenue, or profits arising from your use of Ampersand.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the website or the application. Continued use after revised terms take effect constitutes acceptance of those terms.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of Ampersand will be resolved in the state or federal courts located in Pennsylvania.
